Indian Confederation of Medical Laboratory Science (ICMLS)

NAME: The name of the Confederation shall be Indian Confederation of Medical Laboratory Science, hereinafter also known as ‘ICMLS’ in short. The ICMLS is registered as nonprofit Professional Association/ Confederation of Medical Laboratory Science Professionals’ Associations and individual’s members from Central Government, State Governments, Autonomous and Private healthcare establishments all over India.

REGISTERED OFFICE: The Registered and Head Office of the ICMLS is situated at Delhi. The ICMLS operate on all India level.

AIMS: That the aims & objectives of the ‘ICMLS’ shall be wholly for the charitable/welfare of general public and medical laboratory professionals. The ICMLS is primarily established to undertake activities for academic & scientific development in Medical Laboratory Sciences. Its income shall be wholly for the overall professional development and to improve the quality of professional education and medical laboratory services without prejudice to the provisions aforesaid, and the following shall be deemed to be the principal objectives:

  1. To improve the quality of professional education and services in Medical Laboratory Science & Technology.

  2. To promote the Research & Development in all major areas of Medical Laboratory Sciences.

  3. To augment the knowledge, study, practices and service conditions of the Medical Laboratory Science & Technology professionals in all possible ways.

  4. To unite all stakeholders i.e. Medical Laboratory Professionals’ associations/ unions/ federation, academic organizations/universities and diagnostic corporate bodies and converge their views on all common policy issues for overall improvement of medical laboratory profession and professionals.

  5. To support and be part of all policy initiatives of various Government Authorities related to standardization of professional education & trainings, curricula development regulation of profession and professionals, capacity building, setting of uniformity in career pathway, job roles, pay scales, cadre restructuring, allowances and for improvement in service conditions.

  6. To be a national unified voice for all Indian Medical Laboratory Professionals working in various Central Government, State Governments, Autonomous bodies and private health care establishments across the country for their cadre/service related issues.

  7. To be an advocate for quality of clinical laboratory results, patient safety and risk management.

  8. To promote scientific collaboration of its members for better health care services.

  9. To promote all societal development and community welfare initiatives even beyond professional boundaries like Blood Donation Camps, Eye donation and organ donation awareness camp, Tree Plantation drive, through organizing National Medical Laboratory Professional Week (NMLPW)

  10. To make every efforts for safeguarding the interests of the public in general and professionals in particular and to create the confidence among Medical Laboratory professionals by enhancing their professional knowledge, skill and competencies.

OBJECTIVES: To achieve above mentioned aims and objectives, following methods shall be followed-

  1. To organize conferences, Continuing Professional Development (CPD) Continuing Medical Education (CME), Scientific Meetings, Seminars, Symposia, Exhibitions for the promotion of its objects.

  2. To promote research & developments activities in all major area of Medical Laboratory Sciences and to grant awards to concerned members from Association fund for outstanding professional activities.

  3. To provide facilities to students, scholars and institutions for the study of research in the Medical Laboratory Technology and Science or in any of it aspects by way of scholarships, fellowships, grants, endowments etc.

  4. To establish, maintain award, either itself or in cooperation with other bodies or persons, prizes and awards for overall development of Medical Laboratory Profession.

  5. To print and publish books, journals and bulletins of Medical Laboratory Science & Technology for the promotion of its objects.

  6. To establish and maintain libraries, reading rooms, laboratories and research centers for the promotion of its objects.

  7. To establish a centralized office and state offices and to appoint necessary manpower for the smooth functioning of the Association.

  8. To take the donations, contributions, grant or subscription in cash or in kind or by will from any person or Trust registered or not, along with specific conditions, not inconsistent with the main objects of the Trust. Such contribution or donation shall form part of the corpus of the ICMLS as if they have been included in the original ICMLS fund.

  9. To consider and express its views on all questions affecting the Medical Laboratory Technology and Science in India and to study, suggest, criticize or otherwise advise or take part in the framing of laws affecting the science and practice of Medical Laboratory Technology Profession.

  10. To do all such other lawful things as may be necessary incidental, conducive or convenient to the attainment of the above objects or any of them.

  11. To grant membership/fellowship to medical laboratory professionals and medical laboratory Associations/federation etc of Medical Laboratory Sciences for a greater alliance of medical laboratory fraternity.

  12. To promote health education and health promotion activities that are in the best interest of the public, patients, medical laboratory profession and professionals.

  13. To collect and present, the views of the members to concerned government authorities for betterment of professional education and practices/services.

  14. To make every efforts for safeguarding the interests of the public in general and professionals in particular.

  15. To create the confidence among Medical Laboratory Professionals by enhancing their awareness and knowledge, facilitating better communications through its own website or any modern web based method of communication.

  16. To organize, establish, conduct, superintend or control all activities, for promotion directly or indirectly, practice, study and research in the Medical Laboratory Technology and Science, or in any of its aspects.

  17. To constitute committees, sub-committees as may be found necessary or convenient for the conduct and management of the affairs of the Association.
  18. To collaborate and affiliate with other national and international scientific and academic bodies for comprehensive development of medical laboratory profession and professionals.

  19. To carry out all such other things as are cognate to the objects of the Association or are incidental or conducive to the attainment of the above objects.

  20. To collect and present, the views of the members to concerned agencies and government for betterment of their services.

MEMBERSHIP The membership of the ICMLS shall be either individual or organizational. The individual membership shall be open for all Medical Laboratory Professionals engaged in professional practice, study, teaching, clinical research and developmental area of the Medical Laboratory Science profession, who fulfills the terms & conditions of the ICMLS without discrimination of religion, caste, colour, creed or gender. The organizational membership shall be available for professional Associations, organizations, institutions, corporate bodies from relevant profession but subject to the approval of the Central Governing Council (CGC) of ICMLS. If the membership is refused to any person or any organization, the reason for refusal shall be communicated to the concerned.

CATEGORIES OF MEMBERSHIP & ELIGIBILITY CRITERIA:

1. Individual Membership

  1. Life Membership: Those who pay one time membership fee according to the Bye-laws laid down for the purpose and fulfills required criteria shall be considered as life Member. This membership is open to medical laboratory professionals i.e. Medical Laboratory Technician, Medical Laboratory Technologists and Medical Laboratory Scientists or any other person having professional qualification i.e. Professional Diploma in MLS/MLT, Professional Degree, Professional Masters and Doctorate Degree or any other recognized qualification included in the schedule of the National Commission for Allied & Healthcare Professions Act-2021 in future shall be eligible for membership.

  2. Student Membership: All students of MLS shall be eligible for student membership. These members will be considered for regular membership subject to completion of their professional qualification and deposition of required fee under rules. Student members may have all the privileges of membership except (I) right of voting (II) right of holding any elected office in the branch and representing the branch in any outside body in any capacity.

  3. NRI/ Overseas Membership:: Non-resident Indians possessing medical laboratory science/technology qualifications included in the schedules of the NCAHP Act-2021 as amended from time to time and residing and/or practicing in any foreign country. When listed as members of ICMLS, shall be attached to the Headquarters under NRI category and called “NRI/ Overseas Members”.

  4. Affiliate Membership: Members from Associations/ Professional bodies affiliated with ICMLS as per rules shall be considered affiliated members on terms and conditions to be decided upon and laid down from time to time.

Note: Members whose names get suspended/ deleted/put on hold by National Commission/ Professional Council, their ICMLS membership will automatically get suspended/deleted/put on hold.

2. Organizational Membership:

The following are major categories under this membership-

  1. Affiliated National Associations
  2. Affiliated State Associations
  3. Affiliated Institutional Associations
  4. Corporate Members

CENTRAL REGISTER OF MEMBERS: There shall be a register of all members of the Association which shall be maintained at the Headquarter Office in such manner and showing such particulars as may be prescribed by the Executive Governing Committee from time to time. Similar register of all members of the State/Territorial/Local Branch shall also be maintained at their respective offices. The Association shall maintain a register of members containing the name, address, occupation, academic qualification, date of membership. The register will be kept open for inspection of the members of the association on requisition to the General Secretary/President.

POWER , DUTIES AND PRIVILEGES OF A LIFE MEMBER:

  1. Every bonafide Life member of the State Unit have got voting right to elect or to be elected in any election of the State Unit.
  2. To submit suggestion for discussion to State Committee & sub-Committee on any matter.
  3. To inspect the accounts, the Register of the State Unit on application with the Secretary on 30 days’ notice.
  4. To forgo his membership after due information in writing to the General Secretary through State Secretary of the State Unit.
  5. To pay subscription or donation within prescribed time.
  6. Life member shall be eligible to participate in election, scientific and academic events of ICMLS.

ORGANISATIONAL FRAMWORK OF ICMLS

  1. National & State Branches Of ICMLS
    1. State Branches of ICMLS: There shall be a State/Territorial Branch of Association for each State/Union Territory in India which shall have minimum 100 members. Once a Branch on getting its minimum membership of 100 shall be treated as a State/Territorial Branch and shall be eligible for constitution of a state body through election process under rules.
    2. National Departmental Branch of ICMLS:CGHS BRANCH or any similar branch from any Govt. Department/Ministries with minimum 100 members.

  2. Independent Affiliated Associations (Institutional, State, Departmental And National Level)
    1. Institutional Association: The local Associations of MLS with minimum 20 members from health Institutions/universities may avail the membership of ICMLS but they will not have any voting right.

    2. State Association: An Association of MLS registered as state body under any Act or recognized by the respective state Government with minimum 100 members.

    3. National Association: An Association/Federation of MLS registered as national body under any Act or recognized by the Government with minimum 200 members.

    4. Departmental Association: This includes the National registered Association of MLS which belongs to a particular Department/Ministry of Central Government like Indian Railway, ESIC or any other similar department with at least 100 members.


  3. Overseas Branches:
    The Overseas Members of the Association may, wherever possible, group themselves into a separate Local body to be named as Overseas Branch of the Association for a Local area in a foreign country as may be determined by the Working Committee of the Association.

  4. Disciplinary Control Over Branches:
    All Branches shall be under the overall control of the ICMLS and governed by Rules and Bye-laws of the ICMLS as amended from time to time. Those of the Association which are individually registered under the Societies Registration Act or under any other Act shall also come under the overall discipline and control of the ICMLS and abide by its Rules & Bye-laws as amended from time to time.


GENERAL MEETINGS, SCIENTIFIC CONFERENCES AND EVENTS OF ICMLS:

  1. There shall be All India Conference of the ICMLS. The Conference shall be held with three sessions i.e. members’ session, delegate’s session and scientific session.

  2. There shall be an All India General Council & Scientific Meet of the ICMLS every year.

  3. c) There shall be a National Medical Laboratory Professional Week (NMLPW) to be organised every years by the ICMLS from 17th to 23rd July all over the Country to promote scientific development and to highlight the role of medical laboratory professional in various important fields even beyond professional boundaries. All matters of the ICMLS shall be decided by a majority whenever necessary. The Proxy will be bonafied or valid by proper written authorization.

  4. d) When necessary Special General Meeting may be called any time by the President/General Secretary with at least a fortnight notice to the general members. The president alone may call the meeting as above.

  5. The agenda shall contain the following items:
    • - Confirmation of the minutes of the previous year’s conference.
    • - Reports (Committees, Treasurer of national body and State Secretaries.
    • - Financial accounts.
    • - Budget for next year
    • - Suggestions from members
    • - Venue for next All India Conference and All India General Council Meeting.
    • - Election of the Central Governing Council and office bearers of ICMLS.
    • - Any other business of the association which it deems fit and proper

SUBSCRIPTION & MEMBERSHIP FEE:

Membership fee for different categories shall be as under-

Note:
  1. Any member seeking “Good Standing Certificate” or verification for foreign assignment/job shall be liable to pay an additional of Rs. 12,000/

  2. The membership fee shall not be refundable in case the member organization or any individual member withdraw its membership or expelled by the CGC of ICMLS at any stage.

  3. *These members will be considered for regular membership subject to completion of their professional qualification and deposition of required remaining fee under rules.

REFUSAL:
The governing body of the trust may refuse Membership to any person, provided reasons for refusal shall be communicated to the person concerned in writing.


EXPULSION:
The governing body of the trust may expel any of its ordinary member on the following grounds:
  • On his/her death.
  • If the member fails to pay the timely subscription continuously for three monthsfrom the due date of paying the subscription.
  • If the member works against the aims and objects of the trust.
  • If the member tenders his/her resignation.
  • If the member fails to attend three meetings of general body continuously without intimation. The reasons of expulsion shall be communicated to the concerned member each expelled member shall have a right to appeal to the general body which may or may not accept the appeal.


APPEALS:
All the appeals shall be referred to the general body of the trust & the decision of the general body shall be final. The reasonfor rejection shall be communicated to the member concerned. This clause willbe applicable as mentioned in termination clauses.


RE-ADMISSION:
A member expelled by the general body can be readmitted provided the member concerned pays all outstanding dues. The decision of the general body shall be final in this regard.


GENERAL BODY OF THE TRUST: (ALL INDIA GENERAL COUNCIL):
There shall be an All India General Council of the ICMLS which shall consist all CGC member and 10 nominated executive body members/office bears/representatives of each States/ UTs/ Departmental/ Ministerial Branches of ICMLS. The meeting of the All India General Council shall be held at least once every year with 2/3rd quorum defined under Rules. No quorum shall be required in the adjourned meeting. An emergent meeting of the General Body may also be summoned on the written request of 3/4th members, with 15 days prior notice for such meetings. The notice period of the general meeting of the General Body shall be 30 days. The following business programs shall be transacted in these meetings:-
  1. To prepare annual programs and policies.
  2. To discuss and to decide all such matters and issues which are directly or indirectly related to the affairs of the ICMLS.
  3. To pass annual budget of the ICMLS.
  4. To appoint in a qualified auditor for conducting annual audit of the ICMLS.
  5. To consider any other business brought forwards by Central Governing Council.


CENTRAL GOVERNING COUNCIL (Executive Body):
The members of the Central Governing Council shall hold the office for 2 years. The meeting of the Central Governing Council shall be held as & when necessary for which 15 days notice will be required & the quorum shall be 2/3rd. The management of the affairs of the ICMLS shall vest in the Central Governing Council consisting of the following:-

3 General Secretary One
4 Joint Secretary Four
5 Treasurer One
6 CGC Member One from each state/UT/Departmental Branch
7 State President One from each state/UT/Departmental Branch
8 State Secretary One from each state/UT/Departmental Branch

FUNCTIONS OF THE CENTRAL GOVERNING COUNCIL (CGC) :
  1. To consider any business brought before the CGC.
  2. There shall be meeting of the CGC once in 6 months.


FUNCTIONING OF STATE BRANCHES/ COMMITTEES OF ICMLS:
In every State and Union Territories of the country the ICMLS should have a State Branch being approved by the CGC.
  1. Name, Office and Language:
    The name of THE State Branches will be Indian Confederation of Medical Laboratory Science followed by name of state (Name of the State Unit/State) and place. The office of the State Unit must be inside the State preferably at the State Capital. Any change in the address by the decision of the general body should be intimated to the CGC, at least one month before. The official language of every state unit must be English or Hindi but the state unit shall be entitled to use regional language provided that any translation must be made in English at the cost or expense of the State Unit. Any correspondence with the Executive Committee and all concern outside State Unit association should be in English/Hindi.

  2. Register of Members:
    State Units shall maintain a register of members containing the name, age, date of birth, addresses, academic qualifications etc. and the date of cessation. The Register will be kept open for inspection of the members of the State Unit and members of the Executive Committee on requisition to the General Secretary/President.

  3. General body Meeting:
    Every year, there shall be at least one general body meeting, including two State Executive Committee meeting. The Annual meeting shall be with two sessions i.e. members and scientific session. The quorum of the General body meeting shall be one-third of the State membership. All matters of the meeting shall be decided by a majority of votes whenever necessary. When necessary Central President /General secretary may call a meeting at any time with at least fifteen days’ notice to the State Secretary. The agenda of meetings shall contain the following items:-
    • - Confirmation of the minutes of the previous general meeting.
    • - Reports (Secretary and Treasurer)
    • - Financial Accounts
    • - Budget
    • - Annual Conference
    • - Suggestion from members
    • - Election of the Executive Committee and office bearers and others if necessary.
    • - Miscellaneous.

    State Branch will submit minutes of the Annual meeting with accounts including income and expenditure within one month of their conference to the Central General Secretary.

  4. Election of State Committees and Departmental Branches of ICMLS:
    The members of the State Committee, Office Bearers, and Internal Auditors of the State Unit will be elected for two years or until next election by the members in the state annual general meeting. If necessary, the State Committee, the members to the State Committee, Office bearers, Internal Auditors may be changed in any general meeting.
    The election sub-committee will be formed in half yearly general meeting of every year with a presiding officer. Nomination must be filed at least one month prior to annual meeting (general). Final list of candidates must be circulated at least one month before the annual general meeting to all concerned. Election will be held directly by secret ballot. Election sub-committee may take other resources with the prior approval of State Committee.

  5. Composition of the State Committee:
    Subject to the control of the General body of members the administration of all affairs of the State Unit shall be carried out by the State Committee consisting of not less than nine (11) and not more than nineteen (21) members including the following office bearers:
    State President 1
    State Vice President 1
    State Secretary 1
    Assistant Secretary 1
    Treasurer 1
    Members 6-16 as per membership size

  6. Meeting of the State Committee
    meeting of the State Committee shall be held at least once in 6 months, at such place and time as the State President or the State Secretary may determine. Any five members of State Committee may requisite the meeting of State Committee and the State Secretary shall summon the same within fifteen days.

    The President or in his absence the Vice-President, shall preside over all meetings of State Committee and members present shall elect a chairman of the meeting from CGC Members. All questions before the meeting will be decided by majority of votes, each member having one vote. The President shall have a casting vote in case of tie. The President at the meeting of the State Committee shall decide all questions relating to the requisitions there of and his decision shall be final and binding. Two third (2/3) members shall be required in State Committee meeting and if a quorum is not present within 30 (thirty) minutes of time, the members present may adjourn the meeting. Adjourning meeting needs no quorum. State Secretary and President will decide regarding conveyance and contingency of the State Committee members and others.

  7. Power and Duties of the State Committee:
    The State Committee shall have general power of supervision and conduct overall administration and managerial affairs of the administration of the State Branch and in particular shall discharge the following duties:-
    1. To arrange the general meetings of the State Branch.
    2. To appoint Sub-Committee with such power and duties as may be considered necessary to expedite.
    3. To keep proper accounts of the State Unit.
    4. To accept donation, gift, subscription, movable or immovable property or the objects of the State Unit.
    5. Taking all disciplinary actions such as removal, dismissal etc.
    6. To establish a State policy of the profession.
    7. To recommend the names of the prize winners to CGC.
    8. To recommend the names of the CGC. for higher education.

  8. Termination of the Membership:
    A member of the State Committee shall cease the member of the State Committee if:
    1. He/ She disobeys the decision of the State Committee.
    2. He/ She resigns by letter addressed to the State Secretary.
    3. He/ She is convicted of any offence in connection with the State Unit.

  9. Removal Of Membership:
    Any member of the State Unit may be recommend for removal of his/her membership by the State Committee on any of the following reasons:-
    1. Having acted against the aims and objects of the association.
    2. Having acted in a manner which undermines the good name of the association and also of the State Unit and the prestige of the profession.
    3. Having undermined the Association itself by stand column and fractionalism.
    4. Having embezzled or mis-appropriated the fund of the Unit.
    5. By accepting the resignation letter.
    6. Has proved to have acted in detriment of the Association.

  10. Delegates:
    Every State Unit must be represented in the Annual General meeting by sending delegates. The list must reach one month ahead. Delegates from state body should be elected in the annual general meeting. The maximum number of delegates will be 10 from each State/UT and Departmental Branches, if any.

  11. Bank Account:
    To keep proper accounts of the State Unit and to open Bank accounts of the State Units in the name of State Unit in a scheduled Banks. Banks accounts will be operated jointly by the State Secretary/ State President and Treasurer of the State Unit. However the permission of Central Governing body is necessary to open a bank account in state.

  12. Funds:
    The State Unit shall have a general fund which shall include all income (donation) from members and other miscellaneous sources. All money belonging to State, some of these immediately required not exceeding Rs. 1000/- shall be deposited in a scheduled Banks. The CGC may be approached for fund with necessary reasons and documentary evidence if necessary.

  13. Internal Auditor:
    : For the purpose of auditing the accounts of the State Units, one member other than the of the member of State Committee shall be appointed by the members at the General meeting as Internal Auditor.

  14. Accounting Year:
    The accounting year of the State Unit shall be according to the English Calendar month from 1st April to 31st March of each year.

  15. Safe Custody Of Fund:
    The State Committee shall be responsible for the safe custody of funds and assets of the State Unit. All movable and immovable property of the State Unit shall be vested in the hands of State Committee. The funds of the State Unit shall be kept in scheduled Bank. The Bank or Post Office accounts shall be Joint account which will be opened by the State Secretary and Treasurer.

  16. Audit:
    Once at least in every year the account of the State Unit shall be examined and correctness of the balance sheet and the income and expenditure account be ascertained by one or more qualified Auditor/Auditors.

  17. Inspection:
    The books of accounts and proceedings of the meetings and statutory books shall be kept in the registered office of the State Unit and shall be open to inspection of the members on requisition to the Secretary giving at least 15 days previous notice in writing.

  18. Election Process To Be Followed For Other Important Posts:
    Under certain circumstances where elections could not be possible in the state, a CGC member can be co-opted by the Central Governing Committee for handling of day to day activities of State unit.


ELECTION & QUORUM
The All India General Council in its biannual meeting will elect all its office bearers & members in the month of March-April, during Conference, after 2 years by secret ballot or by any other constitutional procedure. The quorum of the General Body & The Executive Body shall be 2/3rd.


ELECTION PROCESS OF CENTRAL GOVERNING COUNCIL (CGC) OF ICMLS:
  1. The members of the Central Governing Council, office bearers of the ICMLS shall be elected for two years or until next election by the representative members in the members’ session of the Conference. Any change in the above if necessary duly passed by CGC, shall be placed before General body meeting for approval. The body or member of the CGC, office bearers, internal auditors or Editors may be changed in any general meeting.

  2. Every bonafied member/delegate shall have the right to cast vote and participate in election except those members enrolled within one month of the date of All India General Body meeting.

  3. The election of all the office bearers shall be through secret ballot and member eligible to vote will cast only one vote from the panel of valid nominations of their respective States, which will be written on their ballot paper.

  4. The other procedure of filling the nomination, withdrawals etc. will be laid down by the concerned Election Officer/Returning Officer appointed by the Executive Committee.

  5. The candidate will be declared elected in the order to larger number of votes polled for them. In case of a tie, the decision of the same will be decided by lots.

  6. Every State Unit will get one post in Central Governing Council (CGC) to represent their State.

  7. The Central Governing Council will appoint Election Officer/Returning Officer in Central G.C. meeting. All nomination papers will reach to the Election Officer/Returning Officer fifteen days prior to the All India Conference.

  8. For the post of President, Vice President, General Secretary, Joint Secretaries and Treasurer any bonafied member of ICMLS can file the nomination and shall be elected in the open election in the house in All India Conference irrespective of State.

  9. The post of Internal Auditor, Editor of Journal etc. shall be selected by the CGC.

POWERS & DUTIES OF THE CENTRAL AND STATE OFFICE BEARERS:-


NATIONAL PRESIDENT

He will be the head of the ICMLS & preside over the meeting of the Governing/Executive Body & the All India General Council of the Association. He will have the right of casting vote in the case of tie.


NATIONAL VICE PRESIDENT

In the absence of the President, the Vice President shall enjoy all powers which are entrusted to the President.


NATIONAL GENERAL SECRETARY

The powers of the Secretary shall be as under:-

  1. To sign on behalf of the ICMLS & to conduct its correspondence & to record the proceedings of meeting.
  2. To summon & attend the meeting of General Body.
  3. To call ordinary general meeting if desired on written request of at least 1/3 of Executive Council members.

TREASURER

He shall keep accounts of all receipts & expenditures of the ICMLS and to furnish necessary information of the Executive Body. He will keep with him Rs.5000/- (Rupees five Thousand only) and the balance amount will be deposited in the bank Account of the ICMLS as decided by the Executive Body.


FUNCTIONS OF THE STATE OFFICE BEARERS:

All the Office bearers of the State Unit shall function on honorary basis as follows:


STATE PRESIDENT:

i) President is the constitutional head of the State Unit.
ii) President shall preside over and conduct the meeting of State Committee and general meeting, sign all minutes and shall have a casting vote also.
iii) To assure due effect being given to rules and regulations of State Units.


STATE VICE PRESIDENT:

i) The Vice-President shall assist the President in all functions.
ii) The Vice-President shall perform the function of the President during his absence.


STATE SECRETARY:

i) Secretary is the executive head of the State Unit.
ii) The day to day running of the State Unit as well as for all activities of the State Units.
iii) Maintenance of the papers and files of the State Units.
iv) Correspondence of any subject whenever necessary subject to the approval of the State Committee.
v) Sign on behalf of the State Unit on all receipts for all sums received as subscription, donation etc.
vi) Issuing notices of all the meetings to be held under the auspices of the association and other subjects of interest to the members of the State Unit.
vii) Sign and pay order on bills for payments.
viii) Keeping the minutes of the State Committee and General Meetings.
ix) Preparing the annual reports of the State Unit for Annual General Meetings.
x) Transact all other business subject to the direction of the State Committee.
xi) To exercise general supervision over all the activities of the association and to perform other activities as may be directed by the State Committee or as may be assigned by the President.
xii) To convene all meetings of the State Unit, provided in the constitution.
xiii) To make an expenditure upto the limit of Rs. 1000/- in a month and the expenditure shall be approved by the next State Committee meetings. Secretary may keep Rs. 1000/- in cash for expenditure.
xiv) To execute all the decision of the general meeting and State Committee meeting.
xv) The Secretary in the first week of June and December of the year should send the following to the National General Secretary.

  1. Membership forms duly passed by the State Secretary and President.
  2. Six monthly accounts.

xvi) State Secretary will be responsible to send the copies of agenda, minutes, attendances of members and bonafide members list etc. to the Central General Secretary, 30 days before the commencement of General Meetings and State Committee meetings.


Assistant Secretary:

Assistant Secretary shall assist the State Secretary in all works and work for him during his/her absence.


TREASURER:

i) Treasurer is the financial head of the State Unit.
ii) The safe keeping of the State Unit fund.
iii) Issuing receipts for every collection on behalf of the State Unit.
iv) Operating the Bank accounts in the name of the State Unit jointly with the State Secretary/President with the approval of the CGC
v) To disburse money after proper sanction.
vi) Making payments on proper vouchers.
vii) Maintaining proper office for reference whenever necessary.
viii) Submitting statement of annual accounts before the General meeting.
ix) To be over all in charge of the fund of the State Unit.
x) Treasurer may keep Rs. 1,000/- in hand for Misc. expenses.
xi) All collection should be deposited in Nationalized Bank within 3 days.

FILLING UP CASUAL VACANCIES

The causal vacancies may be filled up by the resolution passed by majority of votes by the governing body upto the next election.


FINANCIAL YEAR

The financial year of the Trust shall be from 1st April of a year to 31st March of next year.


SOURCE OF INCOME:

The fund of the ICMLS shall consist of -
(i) Membership fee received from the member associations/federation/organizations and from individual membership
(ii) Subscription and donation from members Associations/ unions/organization/ Corporates bodies etc.
(iii) Aid from governments, semi government agencies.
(iv) Donations or sponsorship to organize academic, scientific conferences, CME, seminar and social events like blood donation camps, tree plantation, organ donation and eye donation awareness programme etc.


LEGAL PROCEEDINGS

The Trust may sue or be sued in the name of the President/General Secretary as per provisions laid down under the relevant section of the law as also applicable to the Union Territory of Delhi.


MINUTE BOOK

Minute Book shall be maintained at the office by the Governing Body of trustees, minutes of all the meeting, appointments and entry into the office of every new trustee and all other proceedings of the Governing & General Body of the trustees shall be signed by the Chairman/chairperson of the meeting either at the conclusion of the meeting or at the subsequent meeting when they are duly confirmed.


AUDITORS

The yearly account of the Trust shall be from 1st April to 31st March each financial year and the accounts will be audited by a Chartered Accountant appointed by the Trustees for the said period and fees, if paid, shall be outgoing of the income and expenditure of the Trust.


BANK ACCOUNT OPERATIONS

The funds of the Trust shall be kept in a bank. The bank-account of the Trust shall be operated jointly by the treasurer with either of President or General Secretary. The Governing Body may also authorize any other person to operate the Bank Accounts. The Trustees shall maintain a true and correct record of the receipts, payments, incomes and expenses and transactions of the Trust. The Books of Account of the trust shall be audited by a qualified auditor or a Chartered Accountant every year i.e., commencing from 1st April to the 31st March of next year.


INCOME TAX EXEMPTION

All these powers of the trustees prescribed herein of the trust deed shall be exercised as to ensure that the income of the trust would be exempted under section 10 (22), 10 (22A) and /or 11 of the Income Tax Act 1961 as amended from time to time. It is clarified that the power of investment of the trust funds including those mentioned in clauses above shall be exercised in such a manner so as to ensure exemption of the income of the trust under the relevant provisions of the said Act.


ALTERATION OF RULES OF TRUST

The trustees, by a majority are empowered to alter the rules governing the administration of the trust in manner not inconsistent with the objectives of the trust provided in the trust deed.


TERMINATION OF OFFICE OF THE TRUSTEES:

Trustee shall cease to hold office:
i) if he dies,
ii) if he resigns,
iii) if he is adjudged isolvent or found guilty of an offence involving moral turpitude.
iv) if he is found to have acted against the interest of the Trust.
v) if it is unanimously decided by the Trustees specified in para(4) above that his continuation in the Office is against the interest of the Trust.
vi) Upon expiry of the period up to which the Board of trustees have nominated the trustee.


DEFINITIONS & INTERPRETATION

In these Rules and the Bye-Laws made thereunder, unless the context otherwise requires:
a) 'Association' means the Indian Confederation of Medical Laboratory Science hereinafter also known as ICMLS
b) 'Professional Council' means the National or State Councils to be constituted under the NCAHP Act-2021.
c) 'Conference' means the Scientific Conferences organized under the auspices of the ICMLS.
d) 'Local Units' means a Local unit of Medical laboratory Professionals within a particular Institute/city as formed under the Rules.
e) 'State Branch' means a state branch of the ICMLS formed under the rules.
f) ‘Affiliate Bodies’ means any national/state/institutional level Association of Medical Laboratory Science affiliated with ICMLS Headquarter under the rules. They will not have any voting right.
g) ‘Corporate Affiliate’ means any private industry partner/Corporate affiliated to ICMLS for promotion of the objects under the rules. They will not have any voting right. h) 'Head Office' means Head office of the Indian Confederation of Medical Laboratory Science.
i) 'Rules and bye-laws' means rules and bye-laws of the Association.
j) 'Journal' means the official Journal of the Indian Confederation of Medical Laboratory Science or any other publication of the Association so defined.
k) "National Commission" means the National Commission for Allied and Healthcare Profession constituted under sub-section (1) of section 3 of NCAHP Act-2021.
l) ‘Medical Laboratory Professionals’ means Medical Laboratory Technician, Jr. Medical Laboratory Technologist, Medical Laboratory Technologist, Technical Officer, Senior Technical Officer, Chief Technical Officer, Medical Laboratory Scientist/ Biomedical Laboratory Scientists or any other category approved under NCAHP Act-2021.
m) ‘Life Science Professionals’ means the list of categories of life science professionals included in the schedule of the National Commission for Allied & Healthcare Professions Act-2021
n) ‘Central Governing Council (CGC)’ means a Central Governing body of ICMLS constituted under the rules.
o) ‘All India General Council’ means the General body of ICMLS members under rules.
p) ‘Central Governing Council’ means Executive body/Governing body of ICMLS.
q) ‘NCAHP Act-2021’ means National Commission for Allied & Healthcare Professions Act-2021.
r) ‘MLS or MLT’ means Medical Laboratory Sciences or Medical Laboratory Technology.
s) ‘NMLPW’ means National Medical Laboratory Professional Week.
t) ‘All India Conference’ means National Conference of ICMLS.
u) ‘All India General Council Meeting’ means the General body meeting of ICMLS to be held every year under rules.
v) ‘Central Governing Council Meeting’ means Executive body/Governing body meeting of ICMLS to be held and when required under rules.


DISSOLUTION:

In the event of dissolution of winding up of the Trust the assets of the trust remaining on the date of dissolution shall under no circumstance be distributed among the Trustees, but the same shall transferred to other Trust, Society, Association or Institution whose objects are similar to those of this Trust.
